General Terms and Conditions (GTC)

1. Scope

1.1

These General Terms and Conditions apply to all contracts between Luca Karuna Priller (“Photographer”) and her clients (“Client”) regarding photographic services.

1.2

The Photographer provides services exclusively on the basis of these General Terms and Conditions. By placing an order, the Client acknowledges their applicability. Unless otherwise communicated by the Photographer, these terms shall also apply to all future business relationships, even if not expressly referenced again.

1.3

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. Any invalid provision shall be replaced by a valid provision that most closely reflects its intended purpose.

2. Scope of Services

2.1

Luca Karuna Priller offers photography services for various occasions, including weddings, events, portraits, maternity, family and business shoots, as well as other individual assignments.

2.2

The exact scope of services (duration, number of photos, packages, etc.) shall be agreed individually after initial contact and confirmed in writing.

2.3

For standard shoots (approx. 1.5 hours), delivery generally includes 60–100 edited photos. For commercial assignments or special projects, the scope of delivery shall be agreed individually.

2.4

Only edited photos in JPEG format will be delivered. RAW files will generally not be provided unless explicitly agreed otherwise in writing.

2.5

Unless the Client provides written instructions, the Photographer is free regarding the artistic and technical execution of the assignment. This applies in particular to image composition, choice of location, and photographic techniques used.

3. Prices & Payment Terms

3.1

All prices are agreed individually after contact and confirmed in writing. Offers are non-binding until confirmed in writing.

3.2

For smaller shoots (e.g. portraits, family, maternity), payment is made in cash with invoice issuance on-site or via bank transfer before delivery of the images.

3.3

For weddings and larger assignments, a deposit of 50% of the agreed total amount is due upon booking. The remaining balance is payable immediately after completion of the assignment and no later than upon invoicing.

3.4

Usage rights to the photos are transferred to the Client only after full payment of the agreed fee.

3.5

In the event of delayed payment, the Photographer is entitled to withhold image delivery until full payment has been received.

4. Appointments & Cancellation

4.1

Appointments may be rescheduled by mutual agreement, particularly in cases of adverse weather conditions or illness affecting either the Client or the Photographer.

4.2 Cancellation by the Client

• Cancellation more than 14 days before the appointment: free of charge

• Cancellation 7–14 days before the appointment: 25% of the agreed fee becomes due

• Cancellation less than 7 days before the appointment: 50% of the agreed fee becomes due

For weddings, the paid deposit (50%) is non-refundable unless the date is rescheduled at least 30 days in advance.

4.3 Cancellation by the Photographer

If Luca Karuna Priller must cancel an appointment for compelling reasons (e.g. illness, accident, force majeure), any payments already made will be refunded in full. The Photographer will endeavor to arrange a qualified replacement photographer but cannot guarantee this.

5. Copyright & Usage Rights

5.1

All copyrights and related rights to the created photographs remain with Luca Karuna Priller pursuant to Austrian copyright law. Usage rights are granted only if explicitly agreed upon.

5.2

After full payment, the Client receives a simple, non-transferable license for private use. Commercial use requires a separate written agreement and may require an additional licensing fee.

5.3

Unless otherwise agreed in writing, Luca Karuna Priller is entitled to use the photographs created for promotional purposes, particularly on her website, social media platforms, and portfolio. By entering into the contract, the Client expressly agrees to this. Any objection to publication must be communicated in writing before the shoot.

5.4

For any private use of the photos by the Client (e.g. social media), crediting © Luca Karuna Priller as the author is appreciated.

6. Image Delivery via Pic-Time

6.1

Edited photos are provided to the Client via the online gallery service Pic-Time. The Client will receive a personal access link by e-mail.

6.2

The online gallery availability is limited:

• Regular shoots (portraits, family, events, etc.): 3 months from delivery

• Weddings: 5 months from delivery

6.3

The Client is expressly advised to download and back up the photos promptly after receiving the access link. After expiration of the availability period, Luca Karuna Priller assumes no responsibility for data availability.

6.4

The Photographer is not obliged to permanently archive RAW files or original data.

7. Editing & Delivery Times

7.1

The standard delivery time for edited photos is approximately 2–5 weeks after the shooting date.

7.2

For weddings, delivery may take up to 6–8 weeks due to the increased editing workload.

7.3

Express editing may be arranged for an additional fee. The surcharge will be agreed individually and confirmed in writing.

8. Photographic Style & Locations

8.1

The photographic style of Luca Karuna Priller is unique and part of her artistic identity. Fundamental changes to the style are not possible.

8.2

Clients may express preferences regarding locations, moods, and motifs, which will be considered wherever possible.

8.3

The Client bears responsibility for circumstances beyond the Photographer’s control, including weather conditions during outdoor shoots, timely provision of props, or absence of participants.

9. Travel & Accommodation Costs

9.1

For travel to the shooting location, travel expenses of €0.42 per kilometer (official Austrian mileage allowance) will be charged for distances exceeding 50 km from St. Pölten (one-way). These costs are borne by the Client.

9.2

For shoots at distant locations or abroad, the Client shall bear all travel, accommodation, and meal expenses. These costs will be agreed upon in advance and listed separately in the offer.

9.3

Luca Karuna Priller will not cover any such expenses unless otherwise agreed in writing.

10. Equipment & Liability

10.1

Luca Karuna Priller is responsible for her own equipment and ensures it is maintained in proper working condition.

10.2

If the Photographer’s equipment is damaged by the Client or third parties during the shoot, the responsible party shall be liable for repair or replacement costs.

10.3

The Photographer shall not be liable for defects resulting from incorrect or inaccurate instructions given by the Client. Liability is limited to intent and gross negligence.

10.4

In the extremely unlikely event of a total technical failure (e.g. data loss due to memory card malfunction), Luca Karuna Priller shall only be liable for intent and gross negligence. All reasonable measures for data recovery will be undertaken.

11. Third-Party Claims & Permissions

11.1

The Client is responsible for obtaining any necessary permissions from third parties and consent for photographing persons. The Client shall indemnify and hold the Photographer harmless against any related claims.

11.2

If persons who are not contractual parties (e.g. children or guests) are photographed at the Client’s request, the Client is responsible for obtaining the necessary consents.

12. Right of Withdrawal (Distance Selling)

12.1

In accordance with Austrian consumer protection law, consumers may withdraw from a distance contract within 14 days without stating reasons.

12.2

The right of withdrawal expires for services once the service has been fully performed and the consumer has expressly agreed beforehand that performance may begin before the withdrawal period ends.

13. Data Protection

13.1

Luca Karuna Priller processes personal data (name, contact details, and possibly photographs) exclusively for contract fulfillment in accordance with the GDPR and Austrian data protection laws.

13.2

Photos used for promotional purposes (website, social media, portfolio) are based on the Client’s explicit consent pursuant to Section 5.3. This consent may be revoked at any time in writing.

14. Force Majeure

14.1

In cases of force majeure (e.g. natural disasters, pandemics, governmental restrictions) making the shoot impossible, both parties shall be released from their obligations. Payments already made will either be refunded or a replacement date arranged.

15. Amendments to the GTC

15.1

Luca Karuna Priller reserves the right to amend these GTC at any time. Changes will be communicated to the Client in due time and become effective upon publication on the website. Existing contracts remain subject to the GTC valid at the time of contract conclusion.

16. Final Provisions & Jurisdiction

16.1

Austrian law shall apply, excluding conflict-of-law provisions of international private law.

16.2

For all disputes arising from or related to these GTC, the competent court in St. Pölten shall have jurisdiction where legally permissible.

16.3

Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
